The number of unvaccinated children is growing year by year. Mainly because more and more parents are opposed to this form of infectious disease prevention. By avoiding compulsory vaccinations, they risk their child's he alth, but also break the law. What are the pen alties for not vaccinating their child?
Pen alties for not vaccinating childrenare to discipline parents. The fact that the child has not been vaccinated is informed by the Poviat Sanitary and Epidemiological Station in the clinic where the vaccination schedule for a specific child has been established.
Vaccinating children is not inconsistent with patients 'rights, which is more and more often invoked by courts dealing with fined parents' complaints.
The clinic is obliged to remind you about the vaccination date - by phone, letter, during a visit to a doctor not related to the vaccine. If the vaccination date has passed and the parent does not show up with the child, the clinic notifies the Sanepid. Station employees are then obliged to call the parent for an interview and convince him of the benefits of vaccination.
Pen alty for not vaccinating a child
If a parent insists that they will not vaccinate their child, they will pay a fine. Its amount results from the assessment of the circumstances of a given case. Usually these are pen alties of several hundred zlotys. If this does not convince the parent, he may be punished for a minor offense with a fine of up to 1.5 thousand. zloty. When the child's guardian is extremely reluctant, the Sanepid is obliged to apply to the voivode for imposing an administrative fine. In some voivodships, it is even 2.5 thousand. zloty! If this does not work either, the Act on Enforcement Proceedings allows for a one-off fine of up to PLN 10,000. PLN.
The pen alty may be imposed multiple times, but the total amount of coercive fines may not exceed 50,000. zloty. In addition to the fine, the child's guardian must pay a 10% implementation fee of the fine.
Not only money
As the epidemic threat in the case of some infectious diseases has become real, the voivodes, at the request of sanitary inspectors, decided not only to financially punish parents who do not come with their children for compulsory vaccinations, but also to limit the access of this group of children to nurseries and kindergartens financed by the local government.
ImportantVaccinating children is an obligation!
Pursuant to Art. 5 of the Act on preventing and combating infections and infectious diseases in humans, persons staying in the territory of the Republic of Poland are obliged under the terms of the Act to, inter alia, undergo compulsory preventive vaccinations under the National Immunization Program. Unfortunately, some people evade this obligation, which means that the number of unvaccinated children is growing rapidly: from approx. 3,000 to approx. in 2011 to 12,700 in 2014
