The Ministry of He alth informed that failure to undergo vaccination against COVID-19 by persons obliged to do so, e.g. working in hospitals and pharmacies, may result in the employer's introduction of changes in the organization of work and termination of the employment relationship.
Medical professionals, medical students, pharmacists and employees of medical entities have time to undergo the COVID-19 vaccination until March 1, 2022. The Ministry of He alth argues its decision with the safety of staff and patients. The obligation to vaccinate does not apply to people who have contraindications to vaccinations due to their he alth condition.
According to PAP, the Labor Code allows employers to request that the employee submit a declaration of compliance with the COVID-19 vaccination obligation. - Failure to undergo vaccination against COVID-19 may justify the introduction by the employer of changes in the work organization of an employee who did not undergo such vaccination - indicates the Ministry of He alth.
Moreover, failure to vaccinate may also result in the employer terminating the employment relationship with the employee. The Ministry of He alth emphasizes that the actions taken by the employer related to the failure to undergo the SARS-CoV-2 vaccination should be carried out in such a way that they comply with the principle of equal treatment of employees. The Ministry of He alth also points out that the obligation to undergo vaccination against COVID-19 results from generally applicable law.
- Although I do not understand, I admit that directors and managers of medical facilities who are already dealing with the second compulsory vaccination, for example after jaundice vaccination and jaundice vaccination, know how to deal with employees who are not vaccinated. Well, these employees are not allowed to take care of the patient - said Wojciech Andrusiewicz, spokesman for the Ministry of He alth last week.
