Sickness pension , that is, the disability pension is paid by the Social Insurance Institution. However, not everyone can take advantage of it. The condition for granting it is a declaration of total or partial inability to work, therefore it is a benefit paid only to people who have lost the ability to perform it. One of the conditions for receiving a sickness pension is social insurance, in other words - regular payment of social security contributions.

The regulations quite precisely define who can receive a disability pension. To put it simply, these are people who are unable to take up gainful employment due to poor he alth. The loss of job opportunity may be total or partial.

  • Total inability to work can be said when the sick person cannot take up any work and does not promise to be able to work after retraining.
  • Partial inability to work is when the sick person is no longer able to perform work in accordance with his qualifications.

It is worth knowing that the incapacity for work is confirmed by a special commission established by the Social Insurance Institution. It can adjudicate it for a period not longer than five years, unless, according to medical knowledge, there is no chance that the patient will regain fitness before this period, and thus - the ability to start work.

Sick pension: conditions for receiving

To obtain a disability pensionwork, several conditions must be met at the same time: be considered incapable of work and have a certain period of social insurance, both contributory and non-contributory. The regulations also state this quite precisely. According to them, the length of insurance, both contributory and non-contributory, must be, respectively:

  • 1 year - in case of incapacity for work before the age of 20.
  • 2 years - in case of incapacity for work between the ages of 20 and 22.
  • 3 years - if you are unable to work, you are 22 and 25 years old.
  • 4 years - in case of inability to work between the ages of 25 and 30.
  • 5 years - if you become incapable of work after the age of 30. In addition, it is required that this period falls within the last ten years preceding the submission of the pension application. However, this rule does not apply if the claimant is completely incapable of work and can prove 25 contributory years (female) or 30 contributory years (male).

In exceptional cases, such a pension may be awarded to people who do not have the required period of insurance - this is the case if they started work before the age of 18 or within six months of graduating from school or university and were insured for the entire time from the moment of commencement of work until the moment of incapacity for work.

Who can lose the sickness pension?

It is worth knowing that the right to a disability pension will be suspended if the pensioner earns more than 130% of income within three months. average monthly salary (from March 1, 2022 it is PLN 6322.90 gross, but these amounts change from time to time, so it is worth checking them on the website of the Central Statistical Office).

If the income exceeds 70 percent. the average monthly salary (from March 1, the amount equal to 70% of the average monthly salary is PLN 3404.70), but it will not be higher than 130%. of this amount, the benefit will be reduced and a detailed calculation will be made by a ZUS official.

The maximum amount by which the benefit may be reduced is PLN 599.04 for the pension due to total incapacity to work and PLN 449.31 for the pension due to partial incapacity to work (data from March 2022).

Disability pension will not be granted to a person who has an established right to an old-age pension from the Social Insurance Fund or meets the conditions for receiving a universal pension or an old-age pension to which people are lower than the general retirement age - e.g. teachers or miners.

Sickness pension: application

The application for a disability pension is submitted in person at a ZUS branch - the template for a disability pension application can be found on the ZUS website (form ZUS Rp-1R) - you just need to download it, print it and then fill it in. Several documents should be attached to it:

  • questionnaire on contributory and non-contributory periods (form ZUS Rp-6)
  • documents that certify contributory and non-contributory insurance periods - these are employment certificates, insurance cards, certificates from a university about the course of study, etc.
  • certificate of remuneration issued by the employer
  • he alth certificate issued by the attending physician (issued no earlier than one month before the date of submitting the sickness pension application) - form ZUS N-9,
  • medical documentation (e.g. test results, hospital treatment card, etc.), which may be important when making a decision by a ZUS certified physician on the ability or incapacity to work,
  • survey - the so-called job interview - completed by the contribution payer (employer) - form ZUS N-10.

Sickness pension: how much is it?

The amount of the sickness pension depends on whether it is a pension for total incapacity to work or a pension for partial incapacity to work.

ZUS calculates the amount of sickness pension for total incapacity to work in a rather complicated way, adding together:

  • 24 percent the base amount (which is 100% of the average wage without contributions - it is determined every year, and from March 1, 2022 it is PLN 4003.88),
  • 1.3 percent each its calculation basis for each year of contributory periods (taking into account full months)
  • 0.7 percent each assessment basis for each year of non-contributory periods
  • 0.7 percent each the assessment base for each year which is missing to the full 25 years of insurance, counted from the date on which the application is submitted to the date on which the pensioner would reach the retirement age (the so-called hypothetical period).

The pension for partial incapacity for work is lower and amounts to 75%. pensions for total incapacity for work. If the person submitting the application is also incapable of independent existence (which, however, must be determined by a ZUS doctor), he / she is en titled to a nursing supplement, the amount of which is currently PLN 222.01.

From March 1, 2022, the lowest disability pension is:

  • - PLN 1100 per month - disability pension for people completely unable to work
  • - PLN 1,320 per month - disability pension for people completely unable to work as a result of an accident or an occupational disease
  • - PLN 825 per month - disability pension for people partially incapable of work
  • - PLN 990 per month - disability pension for people partially incapable of work as a result of an accident or an occupational disease.
