Patient Rights Bill
I. Patient rights resulting from the direct application of the provisions of the Constitution
1. Everyone has the right to he alth protection - Art. 68 sec. 1.
2. Every citizen has the right to equal access tohe althcare servicesfinanced from public funds, under the conditions and within the scope specified in the act - art. 68 sec. 2.
II. Patient rights in a he althcare facility as provided for in the He althcare Establishments Act 1991
1.Patientreporting to a he althcare institution has the right to immediate he althcare services due to the threat to life or he alth, regardless of the circumstances - Art. 7.
2. A patient in a he althcare institution has the right to:
- he alth services meeting the requirements of medical knowledge, and in a situation of limited possibilities of providing appropriate services - to use a reliable procedure based on medical criteria determining the order of access to services - art. 19 paragraph 1 point 1, art. 20 paragraph 1, paragraph 1 and article. 26,
- providing him with he alth services by persons authorized to provide them, in rooms and with the use of devices meeting specific professional and sanitary requirements - art. 9 sec. 1 and art. 10,
- information about your he alth - art. 19 paragraph 1 point 2,
- expressing consent or refusing to grant him specific he alth services, after obtaining relevant information - art. 19 paragraph 1 point 3,
- intimacy and respect for dignity while providing he alth services - art. 19 paragraph 1 point 4,
- providing him with medical records or indicating another person to whomthis documentationmay be shared - art. 18 sec. 3 point 1,
- ensuring the protection of data contained in the medical records relating to his person - art. 18 sec. 2,
- access to information on patient's rights - art. 19 paragraph 6. and, moreover, in a he alth care facility intended for people requiring 24/7 or all dayhe althcare services, e.g. in hospitals, sanatoriums, he alth and care facilities, a patient admitted to this facility has the right to:
- provide him with:
a) pharmaceuticals and medical materials - Art. 20 paragraph 1 point 2 and art. 26,
b) room and board adequate to he alth - art. 20 paragraph 1 point 3 and art. 26,
c) pastoral care - Art. 19 paragraph 3 point 3,
d) additional nursing care provided by a close person or another person designated by him - art. 19 paragraph 3 point 1,
e) personal, telephone or correspondence contact with people from outside - art. 19 paragraph 3 point 2,
f) indication of the person or institution which the he althcare facility is obliged to notify about the deterioration of the he alth condition of the patient causing a threat to life or in the event of his death - Art. 20 paragraph 2 and art. 26,
g) consent or refusal to be placed in this he althcare facility - art. 21 paragraph 1 and art. 26,
h) to discharge from the he alth care facility at your own request and obtain information from the doctor about the possible consequences of stopping treatment in this facility - Art. 22 sec. 1 and 3 and article. 26,
i) provide him with the necessary assistance and transport him to another hospital, in a situation where, despite the decision of an authorized physician about the need for immediate admission to hospital, he cannot be admitted to that hospital - art. 21.
3. The patient has the right to emergency medical services in the event of an accident, injury, childbirth, sudden illness or sudden deterioration of he alth causing a threat to life - art. 28.
III. Patient rights under the Medical Profession Act 1996
The patient has the right to:
1. providing him with he alth services by a doctor, in accordance with the indications of current medical knowledge, methods and means of prevention available to the doctor, diagnosis of disease treatment, in accordance with the principles of professional ethics and with due diligence - art. 4,
2. obtain medical assistance from a doctor whenever delay in providing it could result in a risk of loss of life, serious injury or serious he alth impairment, and in other cases urgent cases==Art. 30,
3. obtain from a doctor accessible information about your he alth condition, diagnosis, proposed and possible diagnostic and treatment methods, foreseeable consequences of their use or omission, treatment results and prognosis - art. 31 sec. 1,
4. request the doctor to provide information about his or her he alth condition and prognosis if he or she believes that the doctor restricts the information on the basis of thisfor his benefit - Art. 31 sec. 4,
5. deciding on persons to whom the doctor may provide the information referred to in point 3 - art. 31 sec. 2,
6. express a demand that the doctor not provide him with the information referred to in point 3 - art. 31 sec. 3,
7. refusal to consent to a doctor having an examination or providing him with another he alth service - art. 32 sec. 1,
8. consenting to or refusing to undergo a surgical procedure or applying to him a method of treatment or diagnostics posing an increased risk; in order for the patient to make a decision, the doctor must provide him with the information referred to in point 3 - art. 34 sec. 1 and 2,
9. obtain information from a doctor if, in the course of performing the procedure or applying a specific method of treatment or diagnosis, in connection with the occurrence of circumstances posing a threat to the patient's life or he alth, the doctor made changes in their scope - Art. 35 sec. 2,
10. the doctor respects his intimacy and personal dignity - Art. 36 sec. 1,
11. expressing consent or refusing to participate in the provision of he alth services to persons other than medical personnel necessary due to the type of services - art. 36 sec. 1 and 2,
12. apply to a physician for an opinion of a competent specialist physician or to organize a medical council - art. 37,
13. with sufficient prior warning by the doctor about the intention to withdraw from his treatment and indicating to him the real possibilities of obtaining a specific he alth service from another doctor or in a he althcare institution - art. 38 paragraph, 2,
14. keep confidential information related to it and obtained by a doctor in connection with the performance of the profession - art. 40 paragraph, 1,
15. obtain information from a doctor about the negative consequences for him, in the event of consenting to the disclosure of information held by the doctor concerning him - art. 40 sec. 2 point 4,
16. expressing consent or refusal to publicly disclose data enabling the patient's identification - art. 40 sec. 4,
and in addition, the patient who is to be subjected to the medical experiment has the right to:
1. consent or refusal to participate in a medical experiment after the doctor informs him / her about the aims, methods and conditions of the experiment, the expected therapeutic or cognitive benefits, risks and the possibility of withdrawing consent and withdrawing from participation in the experiment at any stage - Art. 24 sec. 1, art. 25 sec. 1 and art. 27 sec. 1,
2. having been informed by a physician about the danger to himhe alth and life that may be caused by the immediate discontinuation of the experiment - Art. 24 sec. 2,
3. withdrawal of consent for a medical experiment at any stage of the experiment - art. 27 sec. 1
IV. Patient rights as set out in the Nursing and Midwife Profession Act 1996
The patient has the right to:
1. providing him with he alth services by a nurse, midwife, licensed to practice, in accordance with the current medical knowledge, methods and means available to him, in accordance with the principles of professional ethics and with special care - art. 18,
2. assisting him by a nurse, midwife, in accordance with her qualifications, in any case of danger of losing his life or seriously detrimental to his he alth - art. 19,
3. obtain information about his rights from a nurse and a midwife - art. 20 paragraph 1,
4. obtain from a nurse or midwife information about your he alth condition in the scope related to nursing care provided by the nurse, midwife - art. 20 paragraph 2,
5. keep confidential information related to it and obtained by a nurse, midwife in connection with the performance of the profession - art. 21 paragraph 1,
6. expressing consent or refusal to disclose to the public data enabling the patient's identification by the nurse, midwife - art. 21 paragraph 4.
V. Patient rights as set out in the Mental He alth Act 1994
A patient with a mental disorder, mentally ill or mentally retarded has the right to:
1. free he alth services provided to him by public psychiatric he althcare institutions - art. 10 sec. 1,
2. free medicines and sanitary articles as well as rooms and meals, if he / she is in a psychiatric hospital which is a public he alth care institution - art. 10 sec. 2,
3. provide him with the type of treatment methods appropriate not only for he alth purposes, but also in view of his interests and other personal interests and striving to improve his he alth in a way that is least burdensome for the patient - Art. 12,
4. unlimited communication with the family and other people when staying in a psychiatric hospital or a social welfare home - art. 13,
5. application for periodic stay outside the hospital without leaving the hospital - art. 14,
6. warn him about the intention to use direct coercion against him; allowing the application of this measure to a patient must result from the Act - Art. 18,
7. warning about the intention to conduct a psychiatric examination without his consent and applicationthe reasons for such a decision; such examination may be carried out if the patient's behavior indicates that due to mental disorders it may directly threaten his own life or the life or he alth of other people, or is incapable of satisfying basic life needs - Art. 21 paragraph 1 and 2,
8. consent to or refusal to be admitted to a psychiatric hospital, except where the provisions of the Act allow admission to a psychiatric hospital without the patient's consent - Art. 22 sec. 1 and art. 23, 24 and 29,
9. informing and explaining to him by a doctor the reasons for admission to a psychiatric hospital in a situation where he did not consent to it and obtaining information about his rights in this situation - Art. 23 sec. 3,
10. withdrawal of prior consent to be admitted to a psychiatric hospital - Art. 28,
11. necessary medical activities aimed at removing the reason for admitting him to the hospital without his consent and familiarizing him with the planned treatment procedures - art. 33 paragraph 1 and 2,
12. discharge from a psychiatric hospital, if he / she remains there without giving his consent, if the reasons for his / her admission and stay in a psychiatric hospital have ceased to exist without such consent - Art. 35 sec. 1,
13. stay in the hospital in the situation referred to in point 17, with his later consent, if, in the doctor's opinion, his further stay in this hospital is purposeful - art. 35 sec. 2,
14. submission, in any form, of an application for an order for his discharge from a psychiatric hospital - Art. 36 sec. 1,
15. to apply to the guardianship court for an order to discharge from a psychiatric hospital after the refusal to discharge from the hospital upon the request referred to in point 19 - art. 36 sec. 3,
16. information on the date and method of submitting the application to the guardianship court referred to in point 20 - art. 36 sec. 3,
17. submitting an application for the appointment of a probation officer, if, while in a psychiatric hospital, he needs help to conduct all his affairs, or cases of a specific type - art. 44 sec. 1,
and has the right to keep secret everything that concerns him, and about which they learned about performing the activities resulting from the act - art. 50 sec. 1.
VI. Patient rights as set out in the Cell, Tissue, and Organ Collection and Transplantation Act 1995
1. The patient has the right to:
- expressing and withdrawing at any time the objection to the collection of cells, tissues and organs after his death - art. 4 and art. 5 sec. 1-4,
- voluntary consent to the doctor to collect cells from him during his lifetime,tissues or organs for the purpose of transplanting them to a specific recipient, if he has full legal capacity - Art. 9 sec. 1 point 7,
- protection of personal data concerning the donor / transplant recipient and keeping them confidential - art. 12 sec. 1.
2. The recipient patient has the right to be put on the waiting list for cell, tissue and organ transplantation and be selected as a recipient based on medical criteria - Art. 13.
