I am a retired teacher. I did not terminate the employment relationship. I'm going to get a sanatorium during the school year. I do not have a leave, I cannot take a sick leave. Can I go to the sanatorium on L4? I spoke to the National He alth Fund, which referred me to ZUS. I was informed at ZUS that it was the competence of the doctor who issued the application to the sanatorium. The sanatorium lasts 21 days and the allowance is covered by the workplace, not by the Social Insurance Institution. ZUS pays sickness benefits over 30 days.
This question raises a lot of ambiguity, as the National He alth Fund has not yet issued a uniform position on this matter.
In my opinion, a stay in a sanatorium can take place as part of a holiday leave or as part of a sick leave. In the first case, the presence in the sanatorium is not considered a sick period. Such period will be accounted for as employee leave. So in your case it will be impossible. Spa treatment for adults lasts 21 days. Treatment is free. You only bear the costs of travel to the spa town and back to your place of residence, the costs of the local tax and the partial payment of food and accommodation depending on the standard of the room.
Please remember that in accordance with the Regulation of the Minister of He alth of 7 July 2011 on referral to spa treatment or spa rehabilitation (Journal of Laws 11.142.835), referral with current test results and information card on treatment hospital treatment, if the spa treatment is a continuation of inpatient treatment, it is verified every 18 months from the date of its issuance. In order to verify the GTC, the NFZ sends a referral to the service provider who issued it. In the event of a positive verification of the referral, the service provider sends the referral to the NHF Branch within 30 days of its receipt. A referral may also be sent by the beneficiary directly concerned. Verification of the referral does not change the queue on the waiting list.
