Hello! I am a neurologist. Epilepsy is a disease in which there is sudden loss of consciousness / disturbance of consciousness. After its diagnosis in a patient, can the doctor / should report this fact to the authorities issuing the driving license? Is it not a medical secret? Regards

A medical secret is a kind of so-called breachable (relative) secrecy. This secret is information about objectively existing facts, information about which only a limited group of people has access. Therefore, a doctor who, during the practice of the profession, found that a person applying for a driving license or having a driving license had a seizure with epilepsy or a suspicion or the presence of epilepsy, regardless of the circumstances, should immediately notify the driving license authority of the need to assess the he alth predisposition of that person. for driving vehicles. A person diagnosed with epilepsy, taking antiepileptic drugs, applying for a driving license category A, A1, B, B1, B + E, T or holding a driving license category A, A1, B, B1, B + E, T may be issue a driving license or extend its validity after presenting a neurologist's opinion confirming that no seizures have occurred in the last 2 years of treatment. After this period, the person undergoes control examinations by a neurologist, every six months for a period of 2 years, then every year for the next 3 years, and then depending on medical indications. A person applying for a driving license category A, A1, B, B1, B + E, T or holding a driving license of category A, A1, B, B1, B + E, T, who has had the first seizure with epilepsy symptomatology, may be issue a driving license or extend its validity after presenting a neurologist's opinion confirming the period of 1 year without seizures. A person holding a category A, A1, B, B1, B + E, T license who has ever been diagnosed with epilepsy or has ever had an epileptic seizure may not be considered fit to drive as part of their official duties. Legal basis: REGULATION OF THE MINISTER OF HEALTH of January 7, 2004 on medical examinations of drivers and persons applying forpermissions to drive vehicles (Journal of Laws of 2013, item 133)
