If there are he alth reasons for a sick leave, an employee, especially during pregnancy, should take advantage of it. On the other hand, the issues of incorrect dismissal from work during pregnancy are considered taking into account the provisions of the labor code related to parentage. Pursuant to Art. 177 par. 1 of the Labor Code: '' the employer may not terminate or terminate the employment contract during pregnancy, as well as during maternity leave, unless there are reasons justifying termination of the contract without notice due to her fault and the trade union representing the employee agreed to terminate the contract ''.
It is also worth mentioning that this provision does not apply to employees who are in a trial period not exceeding one month. An employment contract concluded for a definite period or for the duration of a specific job or for a trial period exceeding one month, which would be terminated after the third month of pregnancy, shall be extended until the day of childbirth. In the above situation, it may be difficult to extend the employment contract every two weeks.
