I am registered in the RUP as an unemployed person without the right to unemployment benefit, I am 63 years old with 40 years of experience. After 2 years of waiting, I received a referral to a spa sanatorium in order to improve my he alth (degeneration of the lumbar vertebrae, hypertension, type 2 diabetes). The period of stay in the sanatorium is 3 weeks. I reported to RUP the date of departure on 27.01-17.02, presenting the document received from the sanatorium stating the date of stay, the clerk copied this document and warned me that I must submit an L-4 medical certificate from a doctor from a sanatorium or family doctor - otherwise I will lose the status of an unemployed person, which it is associated with the loss of insurance, and this in turn, the lack of possibility of further treatment. We live off my wife's teacher's pension, with whom we go to a sanatorium. I called the sanatorium and they will not issue L-4, the family doctor also refuses, explaining that the spa sanatoriums are part of a holiday leave. What to do?

The unemployed person has the right to receive spa treatmentif there are medical reasons to go there. It does not matter whether the person is unemployed or not. It also does not matter if the person is en titled to unemployment benefit. Naturally, the stay in the sanatorium should be documented, and the certificate of the unemployed person's stay at the spa treatment should be submitted to the Labor Office. Spa treatment may take place as part of a holiday leave, but it does not have to. It is worth contacting the Patient's Rights Ombudsman in order to clarify the situation.Legal basis:Regulation of the Minister of He alth of 24 August 2012 amending the regulation on guaranteed benefits in the field of spa treatment (Journal of Laws of 2012, item 971)
