Hello! Can a doctor be liable for issuing a prescription without taking into account the appropriate reimbursement? For example, will he mark a 100% fee, and the patient should receive the drug with a 50% fee? Regards
YES. The new contract for issuing reimbursed prescriptions was introduced by the Order of the President of the National He alth Fund No. 38/2012 / DGL. It gives the Fund the right to impose a contractual pen alty on the doctor in the amount of PLN 200 for an incorrectly issued prescription. The doctor can not make a mistake, for example, using 50%. drug reimbursement where 100% is required. The reverse is also unacceptable - the doctor prescribes a drug that is not reimbursed in whole or in part. Additionally, prescription of a medicine that is inconsistent with 24 legal acts regulating the issue of prescribing may be considered incorrect prescription (e.g. prescribing a medicine without a certificate from a specialist confirming the diagnosis or prescribing a medicine to a person with special authorization without verifying them). Individual types of pen alties may be added up. For incorrect indication of the refund on the prescription, the pen alty will be PLN 400 (PLN 200 for the prescription and PLN 200 for the level of payment). Legal basis: Annex No. 1 to the order No. 38/2012 / DGL of the President of the National He alth Fund of 30 June 2012.
