WZW C - compensation, annuity.
In the case of hepatitis B infection, the injured patient will be en titled to 1) a one-time compensation to cover any resulting costs, an appropriate amount for medical expenses, costs of preparation for another profession. 2) disability pension. This compensation covers all expenses related to the infection. These are the costs of hospitalization, consultations with specialists, costs of medicines, special nutrition, the purchase of prostheses, expenses related to transporting the patient to the hospital, for treatments, costs of rehabilitation treatments. The costs incurred must be proven. Pursuant to Art. 444 § 1 of the Civil Code, at the request of the injured party, obliged to repair the damage, should also pay in advance the sum needed for the costs of treatment, and if the aggrieved party has become an invalid, also the sum needed to prepare for another profession. The injured party is en titled to a pension in the event of: - total or partial loss of his earning capacity, - increasing needs of the injured party, - diminishing prospects for success in the future. The increase in needs is a future loss, expressed in the constantly recurring expenses to meet these needs and may constitute the basis for claiming the costs of treatment with combination therapy. These are also the costs of regular treatments, rehabilitation, and special nutrition. The pension may be granted as a permanent or temporary pension (if the damage cannot be precisely determined at the time of the judgment, or if the end of the effects of hepatitis B can be relatively accurately determined). Legal basis: The Civil Code Act (Journal of Laws of 1964 No. 16 item 93 as amended)
