My father (87 years old) is a war invalid, he has no leg. He is in the first disability group. I know that war invalids have priority in the line to see the doctor. The question is, what is this priority and in what situations? Recently, my dad was feeling unwell and we called an ambulance. We waited several hours in the hospital for the emergency department. Does it have priority in such a situation? Does it have priority, for example, for cataract surgery, if the waiting time in the queue is a year or two?

In my opinion, this will not be possible. However, everything may depend on the interpretation of the Ministry of He alth or the National He alth Fund, to which one should turn with this question.

The legal basis for obtaining he althcare services financed from public funds out of sequence is Art. 47c of the Act of 27 August 2004 on he alth care services financed from public funds (Journal of Laws of 2008, No. 164, item 1027, as amended).

Regardless of whether it is a queue within the meaning of Art. 20 et seq. u.ś.o.z. or a different kind of queue, e.g. to a doctor, the service provider is not en titled to create additional rights not resulting from the provisions of generally applicable law. So war invalids may be admitted out of sequence on the day of reporting, and not for scheduled treatments in accordance with the waiting list.

War, military or veterans are en titled to benefits out of sequence in pharmacies and medical facilities of any type. If the provision of the service is not possible on the day of notification, the service provider sets a date other than the order of admissions resulting from the waiting list he keeps. The outpatient specialist care service cannot be provided later than within 7 working days from the date of notification.

In addition, military invalids are en titled to free supplies of medicines included in the lists of basic and complementary medicines, and up to the limit (art. 45). War and military invalids and repressed persons are en titled to free orthopedic medical devices and auxiliary devices up to the price limit specified in the regulations (Article 47). As war and military invalids, veterans,oppressed persons and civilian blind victims of hostilities, you have the right to receive any type of outpatient specialist advice and services - without referral.
